A Regulation That Is Transforming the Sector
Regulation (EU) 2025/40 on packaging and packaging waste has been applicable since 12 August 2026. It replaces Directive 94/62/EC and establishes a new framework for the entire life cycle of packaging: design, sustainability, recyclability, labelling and waste management.
Key Changes
100% Recyclable by 2030
All packaging placed on the European Union market must be 100% recyclable by 2030. The Regulation sets recycling targets of 65% by 2025 and 70% by 2030 for all packaging waste.
Harmonised Labelling
The Regulation introduces mandatory, harmonised labelling across the EU to facilitate waste separation at source. The European Commission will define the specific labels and specifications through implementing acts.
Restrictions on Food-Contact Packaging
From 12 August 2026, packaging intended for contact with food must comply with strict PFAS (per- and polyfluoroalkyl substances) limits. Medical packaging and infant food packaging are subject to specific exemptions.
Expanded Definition of Packaging
The Regulation now classifies as packaging certain items that were previously not considered as such: labels attached directly to products, tea bags and stickers for fruit and vegetables. These items will need to meet compostability requirements.
Promoting Reuse and Minimisation
The Regulation reinforces the principle of minimising unnecessary packaging and promotes reusable packaging. For certain plastic and metal formats, deposit-return systems (DRS) become mandatory.
Who Is Responsible?
The main obligations fall on manufacturers, importers and producers of packaging. All operators in the supply chain — material suppliers, importers and distributors — must verify compliance with the requirements and issue an EU declaration of conformity.
